New Vintage by Kriss/OÜ 595, registration code 12391709 address Koidula 15-1, 10125 TALLINN, Estonia (further referred to as „Service provider“) and a client, who makes an order on www.nvbyk.com website and identifies himself by entering personal details to the order (further referred to as „Service user“ make the following www.nvbyk.com usage contract (further referred to „Terms & Contitions“).

1. E-shop

1.1. www.nvbyk.com is an e-shop established by the Service provider and which is used to sell products to Service user.
1.2. www.nvbyk.com is a domain, which belongs to the Service provider.

2. General terms

2.1. The parties of this contracts follow law of obligation, other laws of the Republic of Estonia and other legal acts, and Terms & Conditions with regards to their mutual relations.
2.2. Service provider has the right to make changes to services provided by www.nvbyk.com at any time.
2.3. Service provider has the right to change the Terms & Conditions unilaterally, without having the obligation to notify Service user.
2.4. Products offered by www.nvbyk.com are only sold to natural persons.
2.5. Service user confirmas that he/she is at least 18 years old, and he/she is legally competent, and her/his legal competence is not restricted.
2.6. www.nvbyk.com has the right to refuse registration of an account.
2.7. www.nvbyk.com has the right to delete an account.

3. Products and making a purchase

3.1. The delivery of products ordered from www.nvbyk.com can take from 5 working days up to 3-4 weeks. Availability of products in www.nvbyk.com can be different from what is displayed on www.nvbyk.com website due to technical problems in stock or www.nvbyk.com programs.
3.2. If the order can not be fulfilled, then an employee of www.nvbyk.com will contact the Service user and propose a new delivery date or replacing the product with another product of similar price and quality or returns the money to the Service user. The money is returned in 14 days the latest.
3.3. Product descriptions as displayed in www.nvbyk.com are not complete and can contain unintentional mistakes.
3.4. Service user chooses desired products, agrees to enter relevant details to complete the order (first name, family name, contact telephone, e-mail address, delivery address, postal code) and make the payment via bank link, credit cards, Paypal or by cash in case of self pickup from NVbyK studio at Pärnu mnt. 27-16 Tallinn, Estonia.
3.5. Service user confirms that he/she agrees to pay for the product in full before Service provider fulfills the order.
3.6. Service user is obliged to provide correct data when making the order. Service provider is not responsible for problems caused by incorrect data provided by Service user when making the order.
3.7. Sale takes place when Service user has made an order on www.nvbyk.com, entered all required details and paid for the order.
3.8. www.nvbyk.com has the right to cancel the order/purchase.

4. Prices

4.1. All prices in www.nvbyk.com are in euros and with 20% VAT, as the Service provider is VAT liable: EE101665519.
4.2. Service provider has the right to change prices displayed on www.nvbyk.com at any time. If the Service provider has changed prices after Service user has made an order and paid for it, then the Service provider is obliged to provide the product at the price which was displayed at time of purchase.

5. Delivery time and terms

Products can be shipped to Estonia and all other countries over the world.
5.1. According to the substance and weight of the product one can choose between three delivery methods in Estonia:
5.1.1. Products are delivered to the Service user (to the address written in the order) within the Republic of Estonia with OMNIVA registered maxi-mail service. With this transportation option the cost of transportation payable by Service user is 5.00€;
5.1.2. Products are delivered to SmartPOST or OMNIVA parcel box in Estonia at a shopping centre chosen by the Service user. With this transportation option the cost of transportation payable by Service user is 4.50€;
5.2. In all other countries (except Estonia) Products are delivered to the Service user (to the address written in the order) with OMNIVA international maxi-mail service. With this transportation option the cost of transportation payable by Service user is 7,00€;

6. Withdrawal from the contract before Service provider has fulfilled the contract

6.1. If the Service user would like to withdraw from the contract before the order placed by Service user is fulfilled by Service provider, then the Service user is obliged to notify the Service provider immediately in written form. Written message must be sent to e-mail address info@nvbyk.com. In the e-mail order number, date, and Service user’s contact date have to be displayed.
6.2. If the notification of withdrawal reaches Service provider after the order has been fulfilled, then the goods can be returned as set forth under section 7 – The right to return products.
6.3. Service provider will return the money paid by Service user within 14 days after receiving the notification of withdrawal from the contract.
6.4. The money is returned to the same account, which was used for paying for the product.

7. The right to return products

7.1. Products purchased from www.nvbyk.com can be returned within 14 days after receiving the products.
7.2. If the Service user would like to return products purchased from www.nvbyk.com, then he/she has to contact first Service provider to inform of his/her wish to return the product. The Service user and Service provider will agree, how the product will be transported to the Service provider
7.3. The products, which are to be returned, have to be: in original packaging with original labels and suitable for reselling; returned in 14 days after receiving them; with a copy of the invoice or order. If the product has been damaged, then the Service provider will not return the money to the Service user.
7.4. Returning the product is free of charge when products has been delivered to Estonia, but Service user has to follow instructions by Service provider, which tranportation method to use. This is clarified by Service provider, when Service user contacts Service provider with the wish to return the products.
7.5. When product is returned, then Service provider is obliged to return the money paid for the product in 14 days counting from the day of receiving the product. The money is transfered to the bank account, which was used by Service user to pay for the product..

8. Personal data and usage of personal data

8.1. Service user gives consent to the Service provider for processing her/his personal data.
8.2. Personal data provided by Service user, when making an order, will be entered to the Service provider’s database and used for offering products to the Service user.
8.3. The personal data is retrieved from the order made on www.nvbyk.com website.
8.4. The following personal data is stored in Service provider’s database: first name, family name, contact phone, e-mail address, address: town, street, house no, appartment no, postal code, gender and age.
8.5. Personal data is processed by OÜ 595/New Vintage by Kriss, registration code 12391709, address Koidula 15-1, 10125, TALLINN, EESTI.
8.6. Personal data which is needed for transporting the products to Service user will be given to companies offering the transportation service.
8.7. Protection of personal data is backed with specific security measures.
8.8. Service provider is obliged not to give out personal data to third parties.
8.9. Service provider has to give out personal data, when required by law.
8.10. Service user has the right to check his/her personal details, modify them or delete them from the database.
8.11. Service user gives consent to Service provider to send order confirmation to his/her e-mail address entered to the order.
8.12. By registering with www.nvbyk.com, Service user gives consent to receive information about campaigns and special offers via e-mail or SMS.

9. Customer Satisfaction

9.1. Service provider is responsible if the product does not correspond to Terms & Conditions. If the product does not correspond to Terms & Conditions, then Service user is obliged to notify Service provider immediately, but not later than 14 calendar days after receiving the products.

10. Terms and Conditions

10.1. Service user is obliged to familiarize himself/herself with the terms and conditions set forth in Terms & Conditions.
10.2. When placing an order Service user marks a tick in the box „I agree with Terms & Conditions of www.nvbyk.com, Service user assuers that he/she has familiarized himself/herself with the Terms & Conditions, understood it and agrees with Terms & Conditions.
